Filing a complaint against a landlord or property manager

Tenant complaints have a feature almost no other complaint has: you are still in the relationship. The repair you need is in the home you are living in, and the person you are complaining about signs your next lease. That is why so many tenants put up with things for months.

It is also why documentation and anonymity matter more here than anywhere else.

Document it before you complain

Landlord and property management disputes are decided almost entirely on records, and the records have to be built as things happen rather than reconstructed afterwards.

  • Dated photos and video of the problem, retaken as it changes.
  • Every request in writing, even the ones you also made in person, with the date.
  • A log of visits, calls and no-shows, with times.
  • The lease itself, and the clause covering repairs, entry or deposits.
  • Receipts for anything you paid because the landlord did not act.
  • Meter readings, invoices and bank records for money disputes.

Put the request in writing, once, properly

One written request naming the defect, the lease clause or standard it breaches, and a reasonable deadline does more than ten phone calls. Send it to the landlord and to the managing agent, because agents and owners routinely each assume the other is handling it.

Keep it factual and keep the copy. If the matter ever reaches a tribunal or a court, that message is the first thing anyone will ask for.

Which body to escalate to

Housing complaints have more official routes than most, and they differ sharply by jurisdiction. In broad terms: the local housing or code enforcement authority for habitability, safety and disrepair; a property licensing or estate agent regulator for the agent’s conduct; a deposit protection scheme for a withheld deposit; and a housing tribunal or small claims court for money.

Check what exists where you live before you send anything, because sending a habitability complaint to a deposit scheme costs you weeks.

Complaining while you are still the tenant

This is where an anonymous complaint earns its keep. On RDACTD you file against the letting agency or property management company without your name reaching them, so the complaint can be answered on its merits rather than attached to your unit.
